Departments of Housing and Urban-Rural Development of all provinces and autonomous regions, emergency management departments, Hainan Provincial Department of Natural Resources and Planning, Municipal Housing and Urban-Rural Development (Management) Committee, Planning and Natural Resources Committee (Bureau), Emergency Management Bureau, Housing and Urban-Rural Development Bureau of Xinjiang Production and Construction Corps and Emergency Management Bureau:
In order to implement the requirements of the Notice of the General Office of the State Council City, the General Office of the Central Committee of the CPC on Adjusting the Establishment of the Responsibility Organization of the Ministry of Housing and Urban-Rural Development and the Notice of the Central Office on the Transfer of the Responsibility for the Examination and Acceptance of Fire Protection Design of Construction Projects to the Administrative Establishment of Nuclear Increase (No.169 [2018] of the Central Office), we will earnestly do a good job in the transfer of the responsibility for the examination and acceptance of fire protection design of construction projects from fire rescue institutions to the competent departments of housing and urban-rural construction to ensure seamless connection. The relevant matters are hereby notified as follows:
1. The scope of handover and undertaking is the responsibilities of fire protection design review, fire protection acceptance, filing and spot check of construction projects undertaken by fire rescue institutions at all levels in accordance with the Fire Protection Law of People’s Republic of China (PRC) and Regulations on Fire Protection Supervision and Management of Construction Projects (Order No.106 and Order No.119 of the Ministry of Public Security are revised).
2. The period from April 1 to June 30, 2019 is the handover undertaking period for the responsibility of fire protection design review and acceptance of construction projects, and all localities should complete the handover undertaking work before June 30.
3. Since April 1, 2019, where the undertaking institution for the fire protection design review and acceptance of construction projects has been defined, the undertaking institution will accept and be responsible for the fire protection design review and acceptance of construction projects, and local fire rescue institutions can send personnel to assist; If the undertaking institution is not clear, the institution designated by the local people’s government shall accept and be responsible for the examination and acceptance of fire protection design of construction projects.
Four, after the completion of the transfer of the responsibility for the examination and acceptance of fire protection design of construction projects, the local housing and urban and rural construction departments or other departments responsible for the examination and acceptance of fire protection design of construction projects shall share with the fire rescue agencies the drawings and materials related to fire safety inspection and fire fighting and rescue, as well as the results of fire inspection and acceptance.
Five, the transfer to undertake the responsibility of fire protection design review and acceptance of construction projects, in accordance with the requirements of the central government and the relevant provisions of the Ministry of Finance, properly handle the transfer of funds management functions, timely and full transfer of all kinds of funds, as well as budget adjustment, transfer and other work.
