At the press conference, the General Administration of Press and Publication and the National Copyright Administration announced the top ten cases of the special action against online infringement and piracy in 2007:
First, the infringement case of Jin Interactive Company
Since 2000, Yang Construction Committee and others have used the names of "Beijing Golden Interactive Network Technology Co., Ltd." and "Beijing Golden Interactive Technology Co., Ltd." to illegally copy and distribute other people’s copyrighted films for a long time by means of false authorization. After investigation and verification, the above-mentioned companies have authorized more than 1,000 film works without the permission of the right holders, and the illegal business amount exceeds 10 million yuan. The amount of illegal income is huge, which has caused adverse effects at home and abroad and has been suspected of constituting a crime of copyright infringement. At present, the Economic Investigation Department of Beijing Public Security Bureau has finished the investigation, and three suspects, including Yang Construction Committee, have been criminally detained according to law, and the case is under further investigation.
Second, the case of Lai Hui’s private service
On January 17th, 2007, Jilin Copyright Bureau received a report from Shanghai Shanda Company, claiming that the online game "Legend 2" operated by its company was copied by others and operated online, which infringed the company’s copyright. Jilin Copyright Bureau quickly set up a task force to investigate according to some clues provided by Shanghai Shanda Company. After investigation, the server is located in IDC room of Jilin Netcom Company. According to Jilin Netcom Company, these servers are managed by meihekou city Pengbo Network Technology Development Co., Ltd. (the servers are provided by meihekou city Pengbo Network Technology Development Co., Ltd. and placed in Netcom Company for management) and rented (the servers are owned by Netcom Company and leased to meihekou city Pengbo Network Technology Development Co., Ltd.). After further learning from meihekou city Pengbo Network Technology Development Co., Ltd., we know that these servers are rented by a man named Laihui from xushui county, Hebei Province. After preliminary investigation, the task force decided to transfer the case to the public security organ for handling. Detectives from the Network Supervision Department of Jilin Public Security Bureau rushed to xushui county, Hebei Province, and arrested the suspect, Kuaihui, and seized 10 bank cards on the spot for operating online games. After the trial, Miao Hui confessed all the criminal facts: in January 2006, Miao bought the "Legend 2" game version of Shanda from others online. In June 2006, Miao contacted meihekou city Pengbo Network Technology Development Co., Ltd. from the Internet, and through this company, he hosted and rented a number of servers in Jilin City and began to operate "Legend 2".Online games are profitable by selling virtual equipment in the game, and the price of each set of equipment ranges from 50 to 100 yuan. By January, 2007, I had hosted 8 servers and rented 32 servers in Jilin Netcom Company, purchased the online game version of "Legend 2" from Shanda Company for four times, and operated 40 online games of "Legend 2" with a business amount of 500,000 yuan. The case has been tried by the court in chuanying, Jilin, and on July 25th, 2007, he was sentenced to two years’ imprisonment, suspended for two years and fined 100,000 yuan for copyright infringement.
Third, the infringement case of Jining Information Port
In the special campaign to crack down on internet infringement and piracy, the Press and Publication Bureau of the Central District of Jining City, Shandong Province made a key inspection of the local influential portals, and found that there were hundreds of Chinese and foreign movies on the web page of Jining Information Port website Jining Information Port II New Vision Theater Broadband Jining Station in China for netizens to download and watch for free and broadcast local advertisements in these movies without authorization, and immediately made a case report to Jining Copyright Bureau. On September 7th, 2007, Jining Copyright Bureau and Jining Central District Press and Publication Bureau jointly inspected the website. After investigation, it was found that 11 films such as "Wulin Outward Journey" and "Serial Bureau" played on the website were in cooperation with an online company. Although the copyright owner authorized the online communication, the authorization period was exceeded, and 45 films such as "Acacia Disaster" were uploaded by netizens without the authorization of the copyright owner. The Press and Publication Bureau of the Central District of Jining City believes that 56 films such as "Wulin Waizhuan" broadcast on this website use works without the permission of the copyright owner or beyond the authorized period, which infringes the rights and interests of the copyright owner. According to the relevant regulations, the case of illegal dissemination of films on Jining Information Port website is ordered to stop the infringement, and an administrative penalty of 50,000 yuan is imposed.
Iv. Giate Film Network Infringement Case
In the first ten days of August, 2007, the press and publication management office of Shouguang City, Weifang City, Shandong Province, investigated and dealt with the film works provided to the public by the Jiyate film website of Shouguang City without authorization according to the report of Beijing Netshang Culture Communication Co., Ltd. Under the notarization of Shouguang Notary Office, we used the film card sold by Giate Film Website to log on to Giate Film Website, and preserved the evidence of 10 unauthorized films such as drive of life, Fate Comes from Organic, Qin Xun Ji and Shi Nai Corps. After more than half a month’s preliminary investigation and evidence collection, I found that the facts were clear and the evidence was conclusive, that is, I contacted the network supervision brigade of Shouguang Public Security Bureau to communicate the case and find the Giate film website. After investigation, the Giate film website was launched in October 2006, and it was only filed on ICP. From the beginning of operation to being investigated, 15 movie cards were sold, and about 1200 computers in 14 Internet cafes used the movies of this website. The website has 5 servers (purchased by the parties themselves), which are hosted in Qingzhou and Weifang respectively, and all of them have been seized. Shouguang Press and Publication Management Office imposed an administrative penalty of confiscating 5 servers and fined RMB 30,000.
V. jiujiu Music Network
In August, 2007, after the Jingmen Copyright Bureau of Hubei Province received the notice of investigating and handling the case from the Provincial Copyright Bureau, law enforcement officers conducted a long-distance investigation and evidence collection on "jiujiu Music Network", and initially grasped the relevant information and evidence of the case. On the afternoon of August 21st, with the cooperation of the Network Supervision Detachment of the Municipal Public Security Bureau and the Information Industry Bureau, the law enforcement officers of the Bureau registered and preserved the evidence of three infringing servers in the home of the person involved, Bai Zhengfu, and seized them to the Municipal Bureau. The "jiujiu Music Network" was closed. After investigation, Bai Zhengfu, male, 34 years old, with high school education, worked as a computer technology professional in Jingmen Computer City from 2000 to 2005, and founded jiujiu Music Website in March 2006. The website has 3 servers with a space of 1200G, and there are 170,000 music works, all of which were downloaded from the Internet privately. About 90% of these music works were not authorized by the copyright owner, and about 10% were sent to the website by the record company for publicity purposes. According to the investigation, the profit-making mode of the website is: mobile phone users pay mobile and Unicom companies when downloading music works, and mobile and Unicom companies pay the website according to the actual clicks, and the actual profit is 500 to 800 RMB per month. According to the relevant provisions of the Copyright Law of People’s Republic of China (PRC) and the Regulations on the Protection of Information Network Communication Rights, Jingmen Copyright Bureau imposed an administrative penalty of confiscating three infringing servers and fined 20,000 yuan.
